Proposed Construction Of A High Pressure Bulk Water Main, Fairyland, Paarl East

The Drakenstein Municipality proposes to construct a 700mm diameter bulk water pipeline with a length of 2700 m in Fairland, Paarl East.

Regulations 386 promulgated in terms of the National Environmental Management Act (NEMA, Act 107 of 1998) identify certain listed activities, which require environmental authorisation from the competent environmental authority, viz. the Department of Environmental Affairs and Development Planning(D: EA&DP) via the Environmental Impact Assessment (EIA) process promulgated in terms of Government Notice No. R. 385 of 21 April 2006. The proposed activity includes the following scheduled activities: 1(k) and 1(m) of Regulation 386 published 21 April 2006. The proposed project therefore requires authorisation from the D: EA&DP, following the prescribed EIA process as detailed in the NEMA, 2006 EIA Regulations.

Aurecon has therefore been appointed by the Lyners Consulting Engineers to assist the Drakenstein Municipality with complying with the requisite environmental requirements for the proposed development.

Current Project Phase

The Draft Basic Assessment Report has been finalised and will be submitted to the decision making authority, viz the Department of Environmental Affairs and Development Planning (D:EA&DP) on the 15 October 2009 for the consideration and decision.

The National Environmental Management Amendment Act , 2008 (Act 62 of 2008) ("the NEMA Amendment Act"), came into operation on 1 May 2009.  The NEMA Amendment Act has implications on the way in which the EIA process is implemented and certain amendments and changes that are applicable to this project have been identified and include changes to the public participation process.  Regulation 59 of Government Notice 385 now stipulates that the final report must be distributed for public comment for a period of 21 days.

Copies of the Final BAR have been lodged at the Paarl Public Library. A comment period of 21 days i.e. from the 15 October 2009 to the 5 November 2009 therefore spplies for all registered I&APs to comment on the Final BAR.  All cooments received will be forwarded to the case officer, Mr Clayton Hendricks of D:EA&DP: Private Bag X9086, Cape Town, 8000 or Fax: 021 483 3633, or Email: chendri@pgwc.gov.za. Once D:EA&DP has reviewed the Final BAR and are satisfied that it contains sufficient information to make an informed decision, they will issue an Environmental Authorisation Decision.  Registered Interested and Affected Parties will be notified of D:EA&DP's decision.
